West Virginia Lottery Taxes: 2026 Rate Research

By · Checked November 6, 2026

West Virginia's 2026 income-tax cut is retroactive to January 1. The Tax Division's updated schedule reaches 4.58% above $60,000 for individuals other than married people filing separately, with $1,950.50 tax on the first $60,000. Married separate filers reach that rate above $30,000. This replaces older schedules that may still appear in lottery material.

Lottery income and the rate cut

West Virginia Code 11-21-77 identifies State Lottery prizes as West Virginia-source income and preserves that character for lump sums, installments and certain transfers. A resident of a neighboring state should not assume the ticket is tax-free because the winner lives elsewhere. The 2026 Tax Division page confirms the income-tax schedule; it does not by itself confirm the Lottery's current claim-time deduction.

Conflicting withholding material

The Lottery glossary found during research still states 4.82% withholding. We do not substitute the new 4.58% income-tax rate for that claim-time figure without confirmation. Ask the Lottery what will actually be withheld, then reconcile it with the return for the payment year. For a ticket bought in Pennsylvania, review both the Pennsylvania source-income rules and West Virginia residence rules; no two-state credit is calculated here.

Calculator coverage and next steps

The shared calculator still marks West Virginia's state rate being verified. These research findings have not been activated in its state data. A federal-only output is incomplete. For a large payment, identify the actual cash amount, the payment year, your residence and the ticket state before comparing estimates. This page does not settle deductions, credits or local taxes.

Use the West Virginia calculator preset with that limitation in mind, review the withheld-versus-owed comparison, and compare cash prizes by amount. State-specific claim deadlines or privacy protections not expressly confirmed above remain being verified; contact the issuing lottery before relying on them.

Common questions

Does withholding finish my return?

No. It is a payment credited against the tax determined on a return. Regular federal lottery withholding is 24% when winnings minus the wager exceed $5,000. The site's 37% federal planning rate is deliberately conservative and does not compute progressive brackets.

Should I add both states' top rates?

No combined result is calculated here. Review source rules and resident credits with both sets of documents. The ticket-state guide explains the questions to ask.
